TERMS OF SALES & WARRANTY AND REPAIR POLICY

 Milcots quotations are based upon the terms and conditions listed below. Any deviation from these terms must be requested in writing for Milcots to evaluate cost and/or schedule impact

PRICES: All prices are firm, fixed, unless otherwise noted

SHIPMENTS: Unless otherwise noted in the quotation, all shipments are FOB Mahwah, NJ. Per the legal definition of "FOB Origin", the customer is responsible of any damage incurred during shipment. Goods shipped FOB origin are not insured by MILCOTS. Customer is strongly encouraged to provide MILCOTS with way of shipment and account number. Should the customer choose to have MILCOTS arrange for the shipment, MILCOTS may impose a 35% handling fee based on the shipment cost.

LIABILITY: All sales made by MILCOTS are expressly contingent upon strikes, fires, accidents and causes beyond our control. Our liability from all causes is limited to the value of the goods sold.

WARRANTY: MILCOTS guarantees products of its manufacture and each part or component thereof against all defects in material and/or workmanship and agree to remedy any such defect at no charge provided that the defective unit is returned, transportation prepaid, to the MILCOTS facility. This warranty extends for a period of one (1) year from the date of shipment, unless specified differently as per the contract. Any product which has been repaired or replaced shall be similarly warranted as to such repair or replacement for the remaining warranty period of the product as originally installed or 90 days from the date of repair or replacement, whichever expires last. 

This warranty does not extend to products which have been subjected to neglect, accident or improper use, nor to units which have been altered by other than MILCOTS personnel.

RETURN OF DEFECTIVE PRODUCTS: No products or part thereof shall be returned to MILCOTS unless the customer first obtains a Return Material Authorization number from an authorized MILCOTS customer service representative. This number shall be clearly labeled on all shipping containers. Containers not so labeled will not be accepted.

Products returned for "in warranty" repair and return must be shipped prepaid to MILCOTS. Products returned for warranty repair are subject to handling charges if no defects are found during our inspection. All products returned to MILCOTS must be packaged to prevent damage during shipment. Any damage that occurs during return shipment is the responsibility of the customer and the shipping company. MILCOTS will return repaired products freight prepaid. Products returned for repair, whether in or out of warranty, which have failed due to misuse or negligence or have components removed, will be repaired in accordance with our standard "out-of-warranty" charges.  Shipping and freight costs for products returned for repair (either in or out of warranty) from outside of the contiguous United States are the responsibility of the customer.

 PROPRIETARY INFORMATION: Milcots designs and processes are proprietary to Milcots. If review of Milcots restricted data is necessary, it may be performed on-site at our facility. Unless specifically mentioned in quotes, Milcots is the Design Authority and Manufacturing Authority for all products developed and sold by Milcots. Milcots retains sole MRB authority for all processes and materials utilized in products developed and sold by Milcots.

QUALITY SYSTEM: Milcots is certified to ISO 9001:2015, and utilizes processes and procedures compliant to ISO 9001:2015 requirements for the design and manufacture of our products.

DOCUMENTATION: Milcots provides ruggedized Displays and Panel PC’s, utilizing COTS components and assemblies, integrated into a unique Milcots package, customized to meet customer’s requirements. Milcots uses customer’s requirements and input to generate an Installation Drawing, which defines the requirements for the product to be delivered. Once agreed to by the customer, the Installation Drawing is placed under configuration management control, and will require the customer’s concurrence prior to any update or changes.

Unless specifically mentioned in the quote, Milcots standard data package delivered with all products is:

  1. Certificate of Compliance
  2. Copy of the executed Acceptance Test Procedure
  3. Shipper
  4. Installation and Interface Drawing
  5. 3D model detailing the electrical and mechanical interfaces

CHANGES: Changes in the terms and conditions of orders may be made only by written agreement between MILCOTS and the customer.
